Terms of Service
These terms govern access to BuildDue. By creating an account or using the service, the customer agrees to them.
Service purpose
BuildDue provides progress-billing workflow tools, calculations, document organization, approvals, reminders, and payment-status tracking. BuildDue does not provide legal, accounting, tax, architectural, engineering, or payment-certification services.
Third-party forms and requirements
BuildDue creates original BuildDue-branded summaries and does not issue or certify official third-party contract forms. Customers are responsible for confirming contract terms, recipient requirements, applicable law, retainage treatment, lien-waiver requirements, and the accuracy of submitted information.
Accounts and authorized users
The account owner is responsible for authorized users, roles, credentials, uploaded data, and activity performed through the company account. Users must provide accurate information and protect access credentials.
Trial and subscriptions
The self-service trial lasts 30 days and has resource limits. After expiration, the account becomes read-only unless a paid license is activated. Paid subscriptions renew according to the selected monthly or annual interval until canceled. Taxes and payment processing are handled through Stripe where applicable.
Acceptable use
Customers may not use BuildDue to violate law, infringe rights, distribute malware, bypass security or plan limits, disrupt the service, probe other company accounts, or upload information they are not authorized to process.
Customer data
Customers retain ownership of their data and grant BuildDue the limited rights needed to host, process, back up, scan, transmit, and display it to provide and protect the service.
Availability and changes
BuildDue may perform maintenance, modify features, or impose reasonable technical limits. The service is provided on an as-available basis. Planned controls reduce disruption, but uninterrupted operation is not guaranteed.
Warranty and liability
To the maximum extent permitted by law, BuildDue disclaims implied warranties and is not responsible for contract disputes, rejected applications, delayed payments, lost profits, or indirect damages caused by customer data, third-party systems, or reliance on generated calculations without review. Any direct liability is limited to fees paid for the service during the three months preceding the event giving rise to the claim.
Termination
Customers may cancel through the billing portal. BuildDue may suspend or terminate access for nonpayment, abuse, security risk, or material breach. Data handling after termination follows the published retention practices.
